But that doesn't mean you can just scatter ashes anywhere in Texas. There are some rules and regulations when it comes to scattering ashes.

According to ATX Cremation, there is no public health risk when scattering ashes since cremation renders ashes harmless. You should still use common sense and pay attention to the law when scattering ashes.

Texas law allows you to scatter ashes over "uninhabited public land, over a public waterway or sea, or on someone's private property with proper consent". And of course you have to remove the ashes from the container unless it's biodegradable.

Officially, the Clean Water Act governs scattering ashes in rivers and lakes. According to ATX Cremation, you may need a permit or approval from the agency that manages the lake or river.

Can You Scatter Ashes at Sea in Texas?

Officially, the Clean Water Act states that ashes must be scattered at least 3 nautical miles from land. You are not supposed to scatter ashes on a beach. If scattering ashes at sea you are supposed to notify the EPA within 30 days.
