In Texas, there are plenty of places across the state that mean so much to people that their final wish is to have their ashes spread in that place or area. In fact, according to ATX Cremation, over 50% of people who are cremated have wished to have their ashes scattered in a "sentimental place".

But that doesn't mean you can just scatter ashes anywhere in Texas. There are some rules and regulations when it comes to scattering ashes.

According to ATX Cremation, there is no public health risk when scattering ashes since cremation renders ashes harmless. You should still use common sense and pay attention to the law when scattering ashes.

Texas law allows you to scatter ashes over "uninhabited public land, over a public waterway or sea, or on someone's private property with proper consent". And of course you have to remove the ashes from the container unless it's biodegradable.

Can You Scatter Ashes on a Lake in Texas?

Officially, the Clean Water Act governs scattering ashes in rivers and lakes. According to ATX Cremation, you may need a permit or approval from the agency that manages the lake or river.

Can You Scatter Ashes at Sea in Texas?

Officially, the Clean Water Act states that ashes must be scattered at least 3 nautical miles from land. You are not supposed to scatter ashes on a beach. If scattering ashes at sea you are supposed to notify the EPA within 30 days.

As long as you remove the ashes from the container, you can scatter ashes via plane.

Can You Scatter Ashes at a National Park in Texas?

ATX Cremation suggested that you ask permission before doing this and some National Parks have their own guidelines on where this can be done, but for the most part, it looks like you can.

When it comes to scattering ashes of a loved one, much of it comes down to common sense and doing so in a way that is respectful of other people and of the land/water that you are on.
