Which Holidays Allow For Firework Sales In Texas?

In Texas, year-round sales are prohibited, but the legislature allows for sales windows for several holidays, including: New Year's Eve, Lunar New Year*, Cinco de Mayo**, Juneteenth*, Independence Day, Texas Independence Day*, San Jacinto Day*, Memorial Day*, and Diwali*. 

* counties can opt in, but not mandated by Texas law

Why is Texas Getting An Extra Firework Sales Day for July 4th This Year? When Is It?

Texas is getting an extra day for the July 4th holiday: July 5th. State law allows for these adjustments each year, and 2026 is allowing the broader window in part, "to allow Texans to fully celebrate the 250th anniversary of American independence."  July 5th also lands on a Sunday this year, so it also allows one more day for families to celebrate during the holiday weekend and for retailers to clear their stock.

Municipal and County Rules Still Apply

This extension in firework sales does not change where people are legally allowed to set them off, as municipal and county rules still apply. Almost all cities/ towns in Texas do not allow setting off fireworks within the city's limits, and drought-affected counties can limit sales/ use of fireworks to prevent wildfires.

Fireworks of all kinds can be incredibly dangerous, even deadly. Even sprinklers can cause severe burns and should not be handled by small children.
