On Monday, December 28th, Texas Tech University asked a federal judge to dismiss the lawsuit filed by former Lady Raider head coach Marlene Stollings.

Stollings had filed the lawsuit against the University and TTU Athletic Director Kirby Hocutt months prior, claiming breach of contract, fraud, defamation and sex discrimination. Texas Tech had claimed that Stollins' conduct contained "objectionable behavior" and eventually lead to her contract being terminated.

Stollings was fired from Texas Tech just a day after a USA Today article was published describing a "toxic culture" within her program.

The University's motion to dismiss said:

When Texas Tech University hired Marlene Stollings as its Women’s Basketball coach it expected that she would conduct herself at all times in a manner consistent with her position as an instructor of students and as a University ambassador [...] Instead, Coach Stollings’ actions towards the students she was entrusted to coach adversely affected their well-being and caused players to leave the team.

KAMC News reports that the motion claims sovereign immunity, which means that people cannot sue the state except in specific circumstances, and therefore the University and Hocutt were protected from Stollings' claims.

TTU also said that the claims of gender and sexuality discrimination are not valid under Title IX.

A rule on whether or not the lawsuit will be dismissed has yet to be filed.
