The Reason Texas Knew Better About Fireball ‘Whiskey’ When Illinois Did Not
A woman from Illinois has filed a class action lawsuit against Sazerac, the maker of Fireball, for misleading consumers about the mini-bottles that are sold at grocery stores and gas stations, as they do not contain whiskey. In fact, they are malt liquor. Excuse me while I shudder at some early 20s mishaps.
The labels for the mini-bottles are strikingly similar to the bottles of the actual whiskey (pictured above), but just say "Cinnamon" in lieu of "Cinnamon Whiskey".
Here in Texas, I doubt you were fooled.
But I do think this woman has a point in Illinois. Because you CAN sell liquor in grocery stores in Illinois. Here in Texas, anything you see outside a liquor store must be wine or malt liquor due to our state laws. So while a Texan can come to a reasonable conclusion about the difference, I can absolutely see someone in another state getting fooled easily. That is misleading advertising, in my opinion, and I think this woman has a strong case.
And since it is a class-action lawsuit, other claimants will have an opportunity to be compensated, should her efforts to sue or reach a settlement be successful. Perhaps a bunch of people will end up with an extra free bottle of "whiskey".
Fireball has had other controversies.
In 2014 a rumor spread that Fireball contained anti-freeze. That is not true, but the American recipe does contain propylene glycol, which is in anti-freeze but also is used state-side as a food additive. A shipment was rejected in European countries because there was too much of the chemical present in the American recipe to fit their standards.
Side note- if you ever get the chance to join a class action lawsuit and you qualify as a claimant- do it! Once I got $860 from an evil bank that really did do me harm (I'll let you guess which one) and once I got 4 cans of diet Red Bull mailed to my house because they do not, in fact, give you wiiiings. I'm kidding, that lawsuit was a little more serious that that. But not by much.
