X vs. Texas: Are New ‘Adult’ Policies A Violation of Texas Laws?
Elon Musk seems determined to make X (f.k.a. Twitter) the Wild West.
But the wild west of Texas might not be having it.
X now allows adult content per its updated policy. However, in 2023 Texas passed a law requiring all adult content websites to use certain age verification methods before allowing users to access those sites.
In protest, some adult websites like P*rnhub and Redtube have disallowed any person in Texas to access their content.
So what is the new adult content policy, and how could it be breaking Texas law?
An excerpt from the X policy (you can read the whole thing here).
We believe that users should be able to create, distribute, and consume material related to sexual themes as long as it is consensually produced and distributed. Sexual expression, whether visual or written, can be a legitimate form of artistic expression.
The policy goes on to state that the material can be nudity, simulated, or real sex acts, and that it can be photographic, AI-generated, or drawn (like a cartoon or hentai). There are caveats, of course, disallowing content that promotes exploration, nonconsent, etc.
Additionally, the content is not allowed in, "highly visible places such as profile photos or banners." Users must be 18 years or older, but here's where things get tricky in Texas.
X does not require the type of age verification required by Texas law to prove that your account is held by a person 18 years or older. So an underage person could just, you know, lie and access sexual content on X, putting X at risk of huge daily fines.
Texas has been proudly aggressive in suing companies that violate the age verification law. Will Texas end up suing X, and therefore fellow adopted Texan Elon Musk? It will be interesting to see how this all unfolds.
