Let's hope you have uninsured driver insurance. This is where your insurance company pays the claim. I'll be fair and honest, it's terrible you'd even have to carry this kind of insurance because it's like paying someone else's insurance.
The next step would be for you to sue the other driver in an attempt to collect payment. Now, think about what you already know. It's highly unlikely that a person who could not get insurance and couldn't pay you off in the first place will have any amount of recoverable money. It's possible you could just be adding attorney fees to your losses.

So what about that other driver? Yes, they could get ticketed, lose their license, and be on the hook for their own vehicle repairs. This isn't going to be a good time for them either, but that's not much of a consolation to you.
So, the bottom line is, if you're hit by an uninsured driver, you are basically out of luck, and that's a very tough and unfair pill to swallow.
