Last month, a 2-year-old girl playing outside of a North Texas daycare facility became trapped in a drainage hole filled with 6 to 7 feet of fecal water when she accidentally fell in. She was discovered "blue and pale" nearly an hour later. Her family's attorney filed a lawsuit that alleges daycare workers failed to act swiftly when she went missing.

According to the suit, the drain cover, which had a warning about "fatal poison gas," was either flipped over or replaced after the child fell in, leaving her trapped.

The case has sparked outrage among parents who trust daycare professionals to keep their children safe. The girl's attorney, Levi McCathern believes the daycare is at fault for handling the situation poorly before it happened, and afterward. He is seeking answers from the daycare and believes they should turn over the surveillance footage of the incident, something they have neglected to do, and take accountability for their actions.

The daycare released a statement that said they built a fence around the drainage hole to ensure this would never happen to another person. They believe whoever worked on the drain hole, before the incident, likely put the lid back on incorrectly, or they put it back on when the little girl was still in there. They also said they have thoroughly reviewed daycare safety policies.
